Estimate what an Ontario employee may be owed on termination — both the Employment Standards Act minimums and the broader common-law range courts often award.
How this estimate works
ESA termination pay. Under Ontario's Employment Standards Act, 2000, most employees with at least three months of service are entitled to notice or pay in lieu: one week if under one year, two weeks for one to three years, then one week per year of service to a maximum of eight weeks.
ESA severance pay. Employees with five or more years of service are also entitled to severance pay if their employer's global payroll is at least $2.5 million (or in certain mass terminations): one week per year of service, including partial years, up to 26 weeks.
Common-law reasonable notice. Unless an enforceable contract says otherwise, employees are usually entitled to "reasonable notice," which is often much more than the ESA minimum. Courts look at factors such as age, length of service, the character of the job and the availability of similar work. Most awards fall below 24 months, though exceptional cases can go higher.
